Regulatory Framework

Income-tax return filing for individuals is governed by Section 263 of the Income-tax Act, 2025 for return-of-income obligations under the new law framework. The return must be filed in the prescribed form, with correct disclosure of salary, house property, capital gains, other income, deductions, tax paid, TDS/TCS, advance tax and self-assessment tax.

ITR-1 (Sahaj) is generally meant for resident individuals with straightforward income such as salary or pension, one house property, other sources such as interest or family pension, and total income within the notified limits. If the taxpayer has capital gains, foreign assets, business income, more complex house-property positions or other exclusions, the appropriate form may shift to ITR-2 or another applicable return.

Which law applies to ITR filing now?
For the new framework, return filing is covered under Section 263 of the Income-tax Act, 2025. Some legacy notices, forms or older assessment years may still show older references, so HRA checks the assessment year before using any section reference.
Can a salaried person always file ITR-1?
No. ITR-1 is only for relatively simple resident individual cases within the notified conditions. Capital gains, foreign assets, business income or certain other situations may require ITR-2 or another return form.
Do you check AIS and Form 26AS before filing?
