Statutory Basis
Trade Marks Act 1999 — Section 18 (Application for Registration)
Section 18 of the Trade Marks Act 1999: Any person claiming to be the proprietor of a trademark may apply for registration by filing Form TM-A at the Trade Marks Registry. The application must specify the class(es) of goods or services under the Nice Classification.
Trade Marks Rules 2017 — Rule 8 (MSME 50% Fee Rebate)
Rule 8 of the Trade Marks Rules 2017 read with the First Schedule (as amended): Individuals, start-ups, and small enterprises are entitled to a 50% rebate on the government fee for trademark applications. Government fee: ₹9,000 per class for companies and other entities; ₹4,500 per class for individuals, start-ups (DPIIT-recognised), and MSME-registered entities (50% rebate under Rule 8). Requires a valid Udyam Registration Certificate for MSME entities.
Nice Classification — 11th Edition (45 Classes)
The Nice Agreement Concerning the International Classification of Goods and Services for the Purposes of the Registration of Marks (Nice Classification), 11th Edition: International classification system used by India's Trade Marks Registry. Classes 1–34 cover goods; Classes 35–45 cover services. Each application must specify the class and a list of goods/services within that class.
MSME Development Act 2006 — Udyam Registration
The Micro, Small and Medium Enterprises Development Act 2006 (as amended): Enterprises must obtain Udyam Registration (formerly Udyog Aadhaar) to qualify as an MSME. Udyam Registration is issued by the Ministry of MSME and serves as the proof of MSME status required to claim the 50% trademark fee rebate under Trade Marks Rules 2017.
Form TM-A — Trademark Application Filing
Form TM-A under the Trade Marks Rules 2017: The prescribed form for filing a trademark application in India. One Form TM-A is filed per class. Multi-class filing requires separate Form TM-A and fee payment for each class. Applications can be filed online at ipindia.gov.in or physically at the Trade Marks Registry offices in Mumbai, Delhi, Chennai, Kolkata, or Ahmedabad.
